The Superintendent of Public Instruction says she will be back to work Monday.
Friday afternoon, Cindy Hill announced her decision in Cheyenne.
Hill said, "Today(Friday) the District Court entered its final judgement ordering that I will be allowed to return as the head of the Wyoming Department of Education.
Hill says she will not continue to challenge Senate File 1-04.
"The powers and I do not plan to appeal, as this will only cause further delays," she said.
She plans on meeting with Wyoming Gov. Matt Mead Monday, before returning to office.
